TERMS AND CONDITIONS

Scope of application

These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all legal transactions concluded via the online store of Jenni Uhren AG (hereinafter referred to as “online store”).

The online store is operated by Jenni Uhren AG (hereinafter referred to as “Jenni Uhren”, “we”, “us”). We reserve the right to amend these GTC at any time. The version of these GTC posted online at the time of the order shall apply. These GTC do not apply to purchases made in Jenni Uhren stores. By placing an order, customers confirm that they are capable of concluding legally binding contracts and are at least 18 years of age.

Sales and delivery conditions

Order process and conclusion of contract

The ordering of a product in the online store by the customer is deemed to be a binding offer to purchase the product subject to these GTC. After receipt of the order, we will send the customer a confirmation of receipt and check the order. The contract between the customer and Jenni Uhren is only concluded when we send a separate order confirmation. If ordered products are not available, we will inform the customer and his order will be considered canceled. Any advance payments already made will be refunded in this case. The customer has no further claims against Jenni Uhren if the order is canceled. Orders can be rejected without justification.

 

Product and price details and terms of payment

The specification and illustration of products in the online store is subject to change and non-binding. Product information is compiled in the online store as customer-friendly as possible, but is not binding. The information provided by the manufacturer (e.g. manufacturer's warranty) is authoritative, provided that it is valid in Switzerland.

All prices are in Swiss francs and include value added tax (VAT). You can choose from the following payment options:

 

a) Prepayment

Our account details for your advance payment can be found in the confirmation e-mail that you receive automatically after completing your order. Your order will be dispatched immediately after receipt of payment.

 

b) Payment by debit and credit cards

Your secure credit and debit card payments are facilitated by Wix Payments. The services of Wix Payments are offered by Wix.com and Adyen B.V. and meet all current security standards.

 

c) Payment with Paypal

You can pay the invoice amount for your order directly with your PayPal account.

 

We reserve the right to change the prices of the products and services offered at any time. The price in the online store at the time of the order is decisive for the contract. Additional services ordered for a fee, such as shipping costs, insurance, etc., are listed separately in the shopping cart and on the invoice.

 

Availability and delivery times

Products offered in our online store are in stock in our store. We usually ship 2 to 3 days after receipt of payment. If, exceptionally, we have a difference in stock, we will inform you as soon as possible and inform you of the new delivery date. If you reject the corrected delivery date, you can cancel the order at no cost and receive a full refund of the purchase price paid.

Claims for damages due to late deliveries are excluded.

Delivery / store collection

All delivery and collection options are available to customers for Jenni Uhren products and services, which are listed in the online store during the ordering process.

After receipt of the order, the customer will be contacted and an individual delivery date agreed. If Jenni Uhren delays delivery, the customer has the right to withdraw from the contract from the 30th calendar day after the originally announced delivery date. In this case, we shall refund to the customer any amounts already paid in advance without interest. There shall be no further claims against us. If the customer does not accept the ordered products on the agreed or indicated delivery date, Jenni Uhren may terminate (cancel) the contract and invoice the customer for the delivery costs incurred and any loss in value.

If the customer does not collect the products ordered from our branch (branch collection) within 

30 calendar days from the date of readiness for collection in the store, we may terminate (cancel) the contract and invoice the customer for any loss in value.

Shipping costs

Orders with a delivery address in Switzerland are shipped at a flat rate. In the event of delivery bottlenecks, Jenni Uhren reserves the right to make partial deliveries. The additional shipping costs incurred will be borne by us. For more information on shipping, please click here.

Obligation to check

Delivered or collected products must be checked immediately and without delay by the customer for correctness, completeness and delivery damage. Delivery damage, incorrect and incomplete deliveries must be reported to us immediately, at the latest within 3 calendar days from the time of collection or delivery. The customer may not put such a product into operation. They must keep it as received in the original packaging and proceed in accordance with our instructions.

Warranty & repairs

Guarantee

Jenni Uhren guarantees that the ordered product is free of defects and functional for 2 years after delivery or collection from the store. A reduced guarantee of 12 months applies to second-hand products (certified used goods). The warranty period continues regardless of the provision of any warranty services.

 

We can provide the warranty as follows:

  • by repair free of charge (the original warranty period continues to apply to all products);

  • by partial and complete replacement with an equivalent used/repaired product (in the case of replacement in the 1st year of the guarantee, the original guarantee period continues to run; in the case of replacement in the 2nd year of the guarantee, the guarantee period is 1 year from the date of replacement);

  • by replacement with a new product by Jenni Watches (new guarantee period of 2 years from replacement);

  • by credit note at the current price (maximum the sales price at the time of the order);

  • Or reduction

Wear parts such as batteries and watch straps are excluded from this guarantee.

If the manufacturer's warranty extends beyond the Jenni Uhren warranty, we will also grant this to the customer. We may, at our discretion, provide the customer with a replacement product during the warranty period. If Jenni Uhren rejects a warranty claim, the customer may purchase the replacement product at the value of the goods at the time of delivery, or the customer is obliged to return the replacement device at his own expense. The warranty rights to which the customer is entitled by law remain unaffected by this guarantee.

Repair outside the warranty

The costs for a repair outside of the warranty shall be borne by the customer. In the case of products that have no detectable defects or where the defect is not covered by the warranty, we reserve the right to charge the customer for the costs of checking the claimed defect and the shipping costs.

Liability and exclusion of liability

Liability is governed by the applicable statutory provisions. Jenni Uhren's liability for contractual or non-contractual claims for damages is excluded for (i) slight negligence, (ii) indirect and consequential damages and loss of profit, (iii) unrealized savings, (iv) damages resulting from delay in delivery and (v) any acts and omissions of Jenni Uhren's auxiliary persons.

Furthermore, we shall not be liable for damage attributable to one of the following causes:

  • improper, non-contractual or unlawful storage, adjustment or use of the products;

  • use of incompatible spare parts or accessories;

  • failure to maintain and/or improper modification or repair of the products by the customer or a third party;

  • force majeure, in particular damage caused by the elements, moisture, falling and impact, etc., for which Jenni Uhren is not responsible, and official orders.

Payment

Payment options

Payments must be made in Swiss francs.

Customers can use the payment methods offered in the online store under “Payment options”.

If payment is made by credit card or other instant payment methods, the amount is debited when the order is placed. When paying by credit card, the payment is subject to validity checks and approvals by the card issuer. We are entitled to exchange the customer's personal data required for these checks with third parties. If the card issuer refuses to authorize payment to us, we are not liable for delays in delivery or non-delivery. If payment still cannot be made 30 days after receipt of the order, Jenni Uhren is entitled to cancel the order.

In the case of payment in advance, Jenni Uhren will only confirm the order after receipt of payment.

 

Default of payment

If the customer fails to meet his payment obligations in whole or in part, all outstanding amounts owed by the customer to Jenni Uhren under any title shall become due immediately (in the case of advance payment within 8 calendar days of the first reminder) and Jenni Uhren may demand immediate payment and suspend further deliveries of products to the customer.

Customers shall also be in default upon expiry of the payment deadline set for them without further reminder and shall be liable to pay default interest of 5% per annum. We are also entitled to charge a reminder fee of up to CHF 10.00 per payment reminder as well as other fees, in particular the costs of any debt collection proceedings. The customer agrees that Jenni Uhren may forward the customer data to an external debt collection agency for the collection of any outstanding debts.

Retention of title

All delivered items remain the property of Jenni Uhren until the purchase price (including all surcharges) has been paid in full. Pledging, transfer by way of security, processing or transformation is not permitted without the express consent of Jenni Uhren. We are entitled to have the delivered goods entered in the retention of title register in accordance with Art. 715 of the Swiss Civil Code. If the customer is in arrears with any payment obligations to us, all existing claims shall become due immediately.

Changing or canceling the order

Orders oblige the customer to accept the products and services. Jenni Uhren may accept subsequent changes or cancellations of orders placed by the customer at its own discretion and charge a handling fee of 20% of the canceled order value, but at least CHF 60, as well as any loss in value of the canceled products since they were ordered.

If a (partial) delivery impossibility (resolutory condition) occurs after an order or the conclusion of a contract, the customer will be informed immediately by e-mail. If the customer has already paid, this amount will be refunded. If no payment has yet been made, the customer shall be released from the obligation to pay. Further claims for late delivery or non-delivery are excluded.

Return of faultless goods

We grant the right to return ordered products within a maximum of 14 calendar days from the date of dispatch or collection, provided the product is unused, unworn and in the condition in which the customer received it.

 

The products must be professionally packed in their original condition with all accessories and warranty card in the original packaging. Damaged products will not be taken back or will be charged to the customer in full.

Please note that the following items are excluded from the right of return.

  • SALE items

  • engraved items or items ordered especially for you

 

If the customer makes use of their right of return in accordance with the above-mentioned return conditions, we will refund the entire purchase price paid with the exception of any transportation costs paid.

The customer is responsible for the correct shipping method for returns (insurance cover). If more than one product is ordered and delivered in a separate package, these may not be returned in one package, but must be returned separately in the same way as the delivery in order to be covered by insurance.

Data protection

The privacy policy under Privacy Policy is an integral part of these GTC. By accepting these GTC, the customer also agrees to the privacy policy.

Partial invalidity

Should individual provisions of these GTC be invalid or ineffective, this shall not affect the validity of the remaining provisions and these GTC as a whole. The invalid or ineffective provision shall be replaced by a valid provision that corresponds as closely as possible to the meaning and purpose of the invalid or ineffective provision.

Place of jurisdiction and applicable law

All legal relations between Jenni Uhren and the customer shall be governed exclusively by Swiss substantive law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (Vienna Sales Convention) and any amendments and supplements thereto.

All disputes arising out of or in connection with the legal relationship between Jenni Uhren and a customer shall, subject to any other mandatory places of jurisdiction, be settled exclusively by the ordinary courts in Zurich (1).
